Overseas Couples Marrying in Australia

If either partner is applying for immigration, what needs to be done?

Make an appointment with the Celebrant where you will complete and sign the Notice of Intended Marriage. The Celebrant will then type you the necessary letter for the Department of Immigration. Only one of you needs to complete the form for this to be done. Call +612 9884 9333 to make an appointment or email.


Can Overseas Visitors get married in Australia?

Yes. If you get married in Australia you have the same legal rights, and responsibilities, as if you were married outside Australia. This applies to persons born in either Australia or another country.


Fiancé Visa Plan

If you or your fiancé are applying for entry into Australia under the prospective marriage (fiancé) plan I am able to supply you with a letter suitable for presentation to the Consulate, together with a copy of the Notice of Intended Marriage. Consult your Migration Agent or The Australian Department of Immigration for any further details.

For couples who are overseas prior to the wedding, all the arrangements can be completed by telephone, e-mail or by post. Contact me via email for further information regarding the legal requirements (see Contact & Terms page).


What do you need to do after you are married?

British Commonwealth Residents: After your marriage, all couples will need to obtain a registered copy of their Marriage Certificate. This can be arranged for you, or you can obtain this yourselves the next working day from the Department of Births, Deaths & Marriages.

Residents from all other countries: If you live in a non-British Commonwealth country, as well as obtaining your Registered Marriage Certificate, after your marriage you will also need to obtain an Apostile stamp from the Department of Foreign Affairs in Sydney, so you can register your marriage in your country of residence. I can arrange this for you. Note: You can do all this yourselves however you must allow at least 2 working days in Sydney after your marriage to organise this.

IMPORTANT: If these documents are in a language other than English, you will need a certified translation of the documents. If unsure please ensure you present your Original Documents with your Certified Translations of your Original Documents to your Celebrant on your first meeting.

What do you do if I can't find your documents?

If you were born in Australia, you can obtain a copy of your Birth Certificate (and if applicable, the Death Certificate of former spouse) from Births, Deaths & Marriages, in the state in which you were born. If you have divorced and need a copy of your Divorce Certificate or Decree Absolute, then this can be obtained from the Family Law Court in the state in which the marriage was dissolved. www.bdm.nsw.gov.au
